Con
fundamento en los Artículos 1, 8 y 133 Constitucional aunado al Artículo 100 de
la propia Carta Magna al disponer que la función judicial se regirá por los
principios de excelencia, objetividad, imparcialidad, profesionalismo e
independencia; al artículo 23 numeral 1 inciso a) de la Convención Americana
sobre Derechos Humanos; yo, el perito médico Adrián Ramírez López, con cédula
profesional 1396538 presidente de la Liga Mexicana por la Defensa de los
Derechos Humanos A. C, y ex Vicepresidente de la Federación Internacional de
Derechos Humanos (FIDH) —de la que la Limeddh es integrante— además de
pertenecer a la Organización Mundial contra la Tortura (OMCT) y partenaire de
“Trabajar Juntos por los Derechos Humanos” —organismos con estatuto consultivo
ante la ONU—con domicilio para recibir comunicaciones en domicilio Calle Lago 6

acudo ante usted, sin actuar dentro del expediente de referencia ni de ningún
otro, puesto que no soy parte en ellos, para pedirle se sirva tenernos
constituidos como Amigos del Tribunal -a manera de Amicus Curiae-, comparezco
para formular los siguientes elementos de análisis:

I. Objeto del presente memorial
El
objeto del presente escrito en calidad de Amicus Curiae es proveer a este Juzgado de Ejecución Penal de Otumba, de
información y argumentos útiles para que adopte medidas garantes de la
protección de los derechos humanos, que se encuentran comprometidas en el caso
de referencia, así como en todos casos sub judice análogos, para favorecer el
desarrollo de la justicia en México.
Esta
petición en forma de Amicus Curiae se encuentra asimismo motivada por el Código
de Ética del Poder Judicial de la Federación en cuyo Artículo 1, bajo el rubro
de Independencia judicial, se establece que [el juzgador]:
1. Preserva[rá]
el recto ejercicio de su función denunciando cualquier acto que tienda a
vulnerar su independencia.
Es
de interés público que ustedes, como, se impongan de los hechos y razonamientos
de que les hacemos partícipes, a fin de estar en mejores condiciones de
preservar el recto ejercicio de la función que realizan bajo su
responsabilidad, para evitar la consumación de juicios sin garantías.
II. Interés de la petición a modo de Amicus
Curiae
La reforma constitucional en
materia de derechos humanos que entró en vigor en junio de 2011 colocó en el
centro de la actuación del Estado Mexicano la protección y garantía de los
derechos humanos reconocidos en la Constitución y en los tratados
internacionales ratificados por éste. Por ello, se trata de una reforma que
impacta de manera sustantiva en la labor de todas las autoridades del país,
toda vez que deben hacer efectiva la aplicación de la totalidad de las
obligaciones reconocidas constitucionalmente
Todas las autoridades sin
excepción se encuentran obligadas a asumir una responsabilidad de Estado en la
implementación de esta compleja transformación constitucional; y, en especial,
reconocen aquella que enfrentan las y los operadores de justicia,
particularmente quienes tienen en sus manos la impartición de justicia o
funciones asociadas con la defensa –tanto jurisdiccional como no
jurisdiccional– de los derechos humanos, para desarrollar todas sus acciones
desde el nuevo paradigma que supone la incorporación de una perspectiva de
derechos humanos.
Lo anterior implica, entre
otras cuestiones, el replanteamiento de estructuras y categorías de pensamiento
utilizadas tradicionalmente por las y los juristas, además del desarrollo de
una profunda reflexión sobre el papel de la impartición de justicia en un
Estado democrático y constitucional de derecho.
En estas condiciones, es
importante resaltar que un cambio de tal envergadura requiere de estrategias y
mecanismos adecuados y eficaces para garantizar que las nuevas disposiciones
constitucionales alcancen los fines para los cuales han sido diseñadas.
Por tal motivo, asegurar el
efecto útil de la reforma constitucional antes señalada sólo será posible en la
medida en que las instituciones, la sociedad y la academia exploren a
profundidad los alcances de la multiplicidad de herramientas con las que ahora
cuentan de manera indubitable. [1]
La
reforma del 2008 al sistema de justicia penal y seguridad pública, vino a
establecer los derechos y garantías, relativos a la judicialización de la
ejecución penal y al régimen de reinserción social, conforme a lo adecuado en
el artículo 18 y 21 constitucional.
Dando
el carácter de auxiliar a la autoridad administrativa de los centros de
reclusión, dejando a los Jueces que cumplan con garantizar los derechos de las
personas privadas de libertad para resolver los conflictos que surjan entre la
Persona Privada de Libertad y la autoridad auxiliar, así como de resolver lo
relativo a la aplicación, modificación y duración de las penas en la fase de
ejecución.
Lo que dio pase a la “reinserción
social” armonizándose con el principio de presunción de normatividad la persona
infractora en el sentido de que las normas penales están dirigidas a personas
que comprenden la consecuencia de sus actos En este sentido,
reinserción social se traduce en el restablecimiento pleno de los derechos de
una persona tras el cumplimiento de la pena con satisfacción de estándares
constitucionales.
Con ello, el sistema
de justicia penal no responde por la transformación de las personas, sino por
la creación de condiciones dignas y seguras en la prisión[2].
Como es bien
sabido el estado mexicano se ha caracterizado por su Progresividad en derechos
humanos. Esto a través de las distintas reformas en derechos humanos como es la
del 2008, con relación a la entrada en vigor de la Ley Nacional de Ejecución
Penal el estado mexicano ha permitido a las personas privadas de libertad tener
la seguridad de que sus derechos para la obtención de un beneficio
penitenciario se encuentran garantizados permitiéndoles tener una mejor certeza
jurídica tanto en su forma material como jurídica.
Los centros
penitenciarios tienen en sus manos la reinserción de las personas privadas de
libertad, esto a través de los ejes consagrados en el artículo 18
constitucional como son: la educación, el trabajo, la capacitación para el
trabajo, el deporte y la salud estos vistos desde la perspectiva de los
derechos humanos. Cada centro deberá de proporcional a las personas privadas de
libertad los medios materiales para la reinserción esto con apego a la regla

de las Reglas mínimas de las Naciones Unidas sobre las medidas no privativas de
la libertad “Reglas de Tokio”.
III. Garantía
a la reinserción social
Los
factores que comprende la garantía de reinserción son tanto los enmarcados en
el segundo párrafo del artículo 18 de la Constitución Federal, así como las
condiciones dignas y seguras dentro de los centros penitenciarios:
Artículo 18
El sistema penitenciario se organizará sobre la base del respeto a
los derechos humanos, del trabajo, la capacitación para el mismo, la
educación, la salud y el deporte como medios para lograr la reinserción del
sentenciado a la sociedad y procurar que no vuelva a delinquir, observando los
beneficios que para él prevé la ley.
Los centros penitenciarios a través de sus autoridades, tiene la
obligación de proporcionar por todos los medios a su alcance la garantía de
reinserción.
En este aspecto el Centro Preventivo y de Reinserción Social de
Otumba Tepachico, es un centro en el que se vive la impunidad y la corrupción,
el cual de acuerdo con el Diagnostico Nacional de Supervisión Penitenciaria
2019, de la Comisión Nacional de Derechos Humanos, tiene una calificación media
de 7.15 tendiente a la baja ya que no garantiza diferentes aspectos de la reinserción
social. (ver imagen)
Con lo que podemos establecer que dicho centro no cumple con los
estándares necesarios para que las personas privadas de libertad puedan acceder
a una garantía de reinserción, al verse menoscabado su derecho a la seguridad
al ser un centro tendiente al auto gobierno por la falta de personal de
seguridad y custodia, propenso a que ocurran actos de violencia dentro del
centro. La incapacidad del centro para garantizar y promover el derecho al
trabajo y la capacitación para este, es un aspecto que daña en lo absoluto a la
garantía de reinserción, consagrada en el artículo 5 y18 de nuestra Carta
Magna.
Tomando como base las Reglas Mínimas
de las Naciones Unidas para el Tratamiento de los Reclusos, (Reglas Nelson
Mandela), para la mejora en el tratamiento de las personas privadas de la
libertad en el Centro Preventivo y de Reinserción Social de Otumba Tepachico,
la autoridad ha sido omisa en el cumplimiento de:
Regla
91 “El tratamiento
de las personas condenadas a una pena o medida privativa de libertad debe tener
por objeto, en la medida en que la duración de la pena lo permita, inculcarles
la voluntad de vivir conforme a la ley y mantenerse con el producto de su
trabajo y crear en ellos la aptitud para hacerlo”.
Relativo al
trabajo la autoridad no ha cumplido con lo establecido en:
Regla 96
1. Los
reclusos penados tendrán la oportunidad de trabajar y participar activamente en
su reeducación, previo dictamen de aptitud física y mental emitido por un
médico u otro profesional de la salud competente.
2. Se
proporcionará a los reclusos un trabajo productivo que sea suficiente para que
se mantengan ocupados durante una jornada laboral normal.
Hacemos
mención que a pesar de estas carencias y circunstancias penitenciarias; Luis
Salvador Escartín González, ha demostrado a lo largo de 18 años privado de su
libertad la capacidad, valentía, voluntad y compromiso para buscar su
reinserción como miembro funcional de la sociedad a la que pertenecía; siendo
el núcleo principal de una familia digna dejando a su hijo Luis Escartin Luna a
la edad de 8 años sin la figura paterna mismo que ha concluido sus estudios a
nivel licenciatura y que actualmente tiene la edad de 27 años, y a su esposa Maria
Teresa Luna Hurtado quien ha sido el sostén económico de un hogar y quien ha
luchado ante todas las instancias jurídicas a nivel nacional e internacional para
demostrar la inocencia de su esposo Luis Salvador Escartín González, siendo el
último recurso la Queja Petición P-484-2014 que se interpuso ante la Comisión
Interamericana de los Derechos Humanos (CIDH) en marzo de 2013, haber perdido a seres queridos siendo sus dos padres y
dos hermanos durante su estancia carcelaria, haber
sido empleado en Petróleos Mexicanos (PEMEX) con numero de Ficha 628272 desde
1988 hasta 2002 día de su detención y con el compromiso laboral que mantenía antes
de haber sido privado de su libertad; que no obstante las graves irregularidades al
Debido Proceso y el agotamiento de todos los recursos jurídicos hechos por la
defensa, fue negada la Teoría del caso en relación a su inocencia, quien fue
objeto y víctima de Fabricación del Delito por Secuestro (2002), por
autoridades Ministeriales y Judiciales del Estado de México y autoridades
Judiciales Federales, donde emitieron fallos y violaciones al Debido Proceso
desde su detención, teniendo una condena de 40 años, y que a la fecha ha estado
compurgando desde el día de su detención (2002) hasta la presente anualidad
(año 2020); lo cual ha dañado su proyecto de vida familiar.
Cumpliendo con los estándares solicitados en el artículo 18 de la constitución,
el artículo 100 de la Ley de Ejecución de Penas Privativas y Restrictivas de la
Libertad en el Estado de México, así como lo estipulado en el articulado de la
Ley Nacional de Ejecución Penal.
En esta medida Luis Salvador Escartín González,
ha mostrado un avance significativo en lo que a los lineamientos previstos en la
ley sustantiva en la materia para la reinserción social referentes al trabajo,
capacitación para el trabajo y la educación, siendo una persona que a pesar de
las circunstancias de precariedad se ha esforzado en el centro penitenciario
donde se encuentra privado de la libertad para formar parte de una sociedad
apegada a normas y reglas tanto de convivencia social como moral, lo que le
permite acceder a un sustitutivo de la pena, esto con relación a la regla 11.2[4]
de las Reglas de Tokio.
IV.
Derecho a la salud
El
derecho a la salud se ha convertido en uno de los ejes rectores de la
reinserción; actualmente el estado de salud de Luis Salvador Escartín González,
se ha venido quebrantando y sufriendo un detrimento a consecuencia de la
tortura, del daño físico y psicológico que sufrió durante su detención para
obligarlo a confesar e inculparse por un delito que nunca cometió; de las
cuales se ha derivado un padecimiento neurológico cuando en el mes de marzo de
2014, estando recluido en el Penal de Otumba Tepachico, sufrió un INFARTO DE
ARTERIA CEREBRAL POSTERIOR, EPILEPSIA DE ORIGEN IDIOPATICO CRIPTOGENO y donde
en este momento se encuentra bajo tratamiento médico y control de forma
esporádica, su estado de salud se ha venido complicado
por dichas secuelas además de que actualmente sufre de depresión y problemas
visuales y con un segundo padecimiento de urología donde actualmente
desconocemos su seguimiento por parte del área médica del penal, lo antes
mencionado se ha venido deteriorando su estado de salud físico y psicológico,
razón por la cual considero que ésta situación ha venido a redundar en los
malos tratos y tortura de que ha sido objeto por parte de autoridades
ministeriales, judiciales y penitenciarias.
El
Centro Prevención y de Reinserción Social Otumba Tepachico no cumple con los
estándares de una atención médica adecuada y ni mucho menos con un tratamiento
neurológico al que necesita por las secuelas antes mencionadas, ya que hoy en
día no se le ha brindado la atención médica con la especialidad en neurología y
urología.
Como
pudimos observar en el Diagnóstico Nacional de Supervisión Penitenciaria 2019
de la Comisión Nacional de Derechos Humanos, el centro de Otumba Tepachico, no
garantiza una estancia digna para las personas privadas de libertad, al contar
con deficiencias en las condiciones materiales y de higiene en el alojamiento
de las personas, dentro de la cocina y comedores, así como en los talleres y
áreas deportivas, las cuales forman partes de los ejes de la reinserción
social.
Conforme
a las Reglas Mínimas de las Naciones Unidas para el Tratamiento de los Reclusos
(Reglas Nelson Mandela), el estado tiene la responsabilidad de que las personas
privadas de la libertad gocen de los mismos estándares de atención medica que
en el exterior (regla 24); los centros penitenciarios contaran con un servicio
de atención medica encargado de evaluar, promover, proteger y mejorar la salud
física y mental de las personas privadas de libertad (reglas 25,26, 27, 30, 31,
32 y 33).
Las
deficiencias en la garantía del derecho a la salud y el derecho a un medio
ambiente sano a través de una estancia digna han hecho que la pena que debe ser
proporcional al delito que se sanciona y al bien jurídico afectado, se haya
convertido en una pena transcendental al ser incompatible con el estado de
salud de Luis Salvador Escartín González, lo cual vulnera lo establecido en el
artículo 22 de nuestra Constitución Política de los Estados Unidos Mexicanos.
V. El
proyecto de vida
El
juzgado aplica criterios que buscan estar con apego a la legalidad, el centro
del enfoque de derechos humanos, pretende que el juzgador actúe buscando la
justicia y para ello debe ponderar en sus fallos que prevalezca ésta más allá
de la legalidad, el espíritu, el alma, la esencia de la justicia.
Otro
de los aspectos que ha dañado la pena que se ha vuelto incompatible,
consecuencia del estado de salud de Luis Salvador Escartín González, así como
de la trasgresión de su derecho a la reinserción y la obtención de un beneficio
de libertad es al proyecto de vida, iniciando por el daño moral y físico al
derecho a la familia el que se ha visto limitado por el régimen de visitas
instaurado dentro del centro, así como por las condiciones de autogobierno que
se vive dentro del centro que no solo afecta a la persona privada de la
libertad, sino que también trasciende a la familia, atendiendo la seguridad de
cada uno de los miembros del núcleo familiar. Pero a pesar de esta situación su
familia esposa e hijo no se han mantenido distantes, sino al contrario durante
estos 18 años que lleva privado de su libertad y que ha sido objeto de diversos
trasladados a centros penitenciaros del Estado de México sin justificación
alguna y con la política criminal que se implementó durante los sexenios de
Felipe Calderón Hinojosa y Enrique Peña Nieto, (Penal de Neza Bordo, Texcoco,
Chiconautla, Otumba Tepachico durante un año en el módulo de alta, Sultepec,
Valle de Bravo y actualmente en Otumba Tepachico) su familia se ha mantenido
cerca de manera fraterna y solidaria con el interno, y que a pesar de todas las
violaciones penitenciarias que llevaron a cabo, se negaron los amparos que se
interpusieron por los traslados injustificados, a sabiendas que no mantiene una
conducta de delincuencia dentro de los reclusorios y ni muchos menos ningún
tipo de adicción; con lo mencionado su familia se ha mantenido cerca de Luis
Salvador Escartín González desde su
reclusión sin dejar de visitarlo a pesar del tiempo, distancia y lugar.
El
principio del interés superior de su primer hijo, se ha visto violentado
indirectamente desde la detención ilegal y de la transgresión a la obtención de
un beneficio de libertad para Luis Salvador Escartín González, quien en el
momento de su detención lo obligaron a separarse de su primer hijo teniendo 8
años Luis Escartín Luna actualmente 27 años y años después de un segundo hijo
que actualmente tiene 8 años Sebastián Escartín Luna, de quienes se han visto privados
del desarrollo integral de una familia y una vida digna con la figura paterna,
así como las condiciones materiales y afectivas que les permita vivir a través
de un núcleo familiar.
La
privación de la libertad y más cuando deriva de una detención arbitraria, la
fabricación de culpable y violaciones al debido proceso afectan todo el
proyecto de vida en su conjunto. Ocasionando una parálisis de vida productiva a
los 30 años, separado por más de 18 años de su núcleo familiar y laboral, y que
el daño de salud tanto físico como psicológico será irreparable para Luis
Salvador Escartín González como para su familia.
VI.
Pretensiones
Con
lo anterior, pretendo que en este caso particular y en sus análogos que el
juzgador puede identificar, se resuelvan con independencia y con apego a las
reglas del debido proceso para Luis Salvador Escartín González pueda tener
confianza en la imparcialidad de la justicia, garantizando el principio de
Seguridad jurídica y núcleo familiar integro.
La garantía de
un beneficio de libertad a través de la reinserción consagrado en el párrafo
segundo del artículo 18 de la Constitución Política de los Estados Unidos
Mexicanos, involucra uno de los derechos sustantivos más preciados del ser
humano, como lo es la libertad, beneficio que aparte proviene a consecuencia de
un proceso penal, en el cual se concluyó, la responsabilidad de una persona en
la omisión o comisión de un hecho que por ley se califica como delito.
Ahora bien, en
este orden de ideas Luis Salvador Escartín González, se encuentra en tiempo y
forma para ser acreedor al beneficio penitenciario conforme a la “Ley de
Ejecución de Penas Privativas y Restrictivas de la Libertad del Estado” esta
para el Estado de México, la cual regía durante el momento de los hechos;
conforme a lo establecido en el artículo 100 y 111 en correlación al artículo
106 de dicha ley. Luis Salvador Escartín González de acuerdo a la operación aritmética fue sentenciado a 40
años; las tres quintes partes de dicha sentencia equivaldría a 24 años, menos
los dos años concedidos, sería de 22 años; actualmente LSEG ha compurgado la pena de prisión de 18 años 1 mes a partir del 8 de
octubre de 2002, teniendo en relación los días laborados equivalentes a 5,671 días hasta febrero 2020, que
realizando la conversión tendría a su favor 2,835 días, que equivalen a 7 años 7 meses; por lo que al realizar la suma tenemos un total de
25 años 10 meses, es decir que
LSEG tiene el tiempo jurídico para la
procedencia del beneficio correspondiente a la libertad condicionada con
relación a la remisión parcial de la pena y el tratamiento preliberacional; con
apego al derecho a la reinserción social garantizado en el Art. 18 Constitucional.
Se solicita entonces, que el proceso de beneficio de
Luis Salvador Escartín González sea apegado a derecho, respetando el derecho al
debido proceso de nuestro estado democrático, de igual manera atendiendo a los
derechos del bloque de constitucionalidad, así como al control difuso de
convencionalidad, al principio pro persona y al principio internacional de Ius cogens.
Así las cosas, la Liga Mexicana por la Defensa de
los Derechos humanos y otras organizaciones hermanos de alerta temprana red y
defensoras de derechos humanos nos solidarizamos en la causa por Luis Salvador
Escartin González, se le respeten dentro del proceso en el Juzgado de Ejecución
Penal para obtención de un beneficio penitenciario, todos los derechos en
marcados en la Constitución Política de los Estados Unidos Mexicanos y en los
tratados internacionales firmados y ratificados por el Estado Mexicano.

El objetivo de la supervisión es disminuir la reincidencia y ayudar al
delincuente en su reinserción social de manera que se reduzca a un mínimo la
probabilidad de que vuelva a la delincuencia.

I.
Purpose of this memorial
The
purpose of this brief, as Amicus Curiae, is to provide this Otumba Criminal
Execution Court with information and useful arguments so that it can adopt
measures that guarantee the protection of human rights, which are compromised
in the reference case, as well as as in all analogous sub judice cases, to
favor the development of justice in Mexico.
This
petition in the form of Amicus Curiae is also motivated by the Code of Ethics
of the Judicial Power of the Federation in which Article 1, under the heading
of Judicial Independence, establishes that [the judge]:
1.
It preserves [rá] the correct exercise of its function by denouncing any act
that tends to violate its independence.
It
is in the public interest that you, as well as, impose yourself on the facts
and reasoning of which we participate, in order to be in better conditions to
preserve the correct exercise of the function that you perform under your
responsibility, to avoid the consummation of judgments without guarantee.
II.
Interest of the petition as an Amicus Curiae
The
constitutional reform on human rights that came into force in June 2011 placed
the protection and guarantee of human rights recognized in the Constitution and
in the international treaties ratified by it at the center of the Mexican
State's actions. Therefore, it is a reform that has a substantive impact on the
work of all the country's authorities, since they must enforce the application
of all the constitutionally recognized obligations.
All
authorities without exception are obliged to assume State responsibility in the
implementation of this complex constitutional transformation; and, in
particular, they recognize that faced by justice operators, particularly those
who have in their hands the administration of justice or functions associated
with the defense - both jurisdictional and non-jurisdictional - of human
rights, to develop all their actions from the new paradigm that involves the
incorporation of a human rights perspective.
The
foregoing implies, among other issues, the rethinking of structures and
categories of thought traditionally used by jurists, in addition to the
development of a deep reflection on the role of the administration of justice
in a democratic and constitutional state of law.
In
these conditions, it is important to highlight that a change of such magnitude
requires adequate and effective strategies and mechanisms to guarantee that the
new constitutional provisions achieve the purposes for which they have been
designed.
For
this reason, ensuring the useful effect of the aforementioned constitutional
reform will only be possible to the extent that institutions, society and
academia explore in depth the scope of the multiplicity of tools that they now
undoubtedly have. [1]
The
2008 reform to the criminal justice and public security system established the
rights and guarantees regarding the prosecution of criminal execution and the
social reintegration regime, in accordance with the provisions of article 18
and 21 of the Constitution.
Giving
the character of auxiliary to the administrative authority of the detention
centers, leaving the Judges to comply with guaranteeing the rights of persons
deprived of liberty to resolve conflicts that arise between the Person Deprived
of Liberty and the auxiliary authority, as well as to resolve matters relating
to the application, modification and duration of sentences in the execution
phase.
What
led to "social reintegration" harmonizing with the principle of
presumption of normativity by the offender in the sense that criminal norms are
aimed at people who understand the consequence of their actions. In this sense,
social reintegration translates into full restoration of the rights of a person
after serving the sentence with satisfaction of constitutional standards.
With
this, the criminal justice system is not responsible for the transformation of
people, but for the creation of dignified and safe conditions in prison [2] .
As
is well known, the Mexican state has been characterized by its Progressivity in
human rights. This, through the different human rights reforms such as the one
of 2008, in relation to the entry into force of the National Law on Criminal
Enforcement, the Mexican state has allowed persons deprived of liberty to have
the security that their rights for the Obtaining a prison benefit is
guaranteed, allowing them to have better legal certainty both in its material
and legal form.
The
prisons have in their hands the reintegration of people deprived of liberty,
this through the axes enshrined in article 18 of the Constitution, such as:
education, work, training for work, sports and health, these seen from a human
rights perspective. Each center must provide the persons deprived of liberty
with the material means for reintegration, in accordance with rule 10.1 [3] of the
United Nations Minimum Rules on non-custodial measures "Tokyo Rules".
III.
Guarantee of social reintegration
The factors that comprise
the guarantee of reintegration are both those framed in the second paragraph of
article 18 of the Federal Constitution, as well as the dignified and safe
conditions within prisons:
Article 18
The penitentiary system will be organized on the basis of respect
for human rights, work, training for it, education, health and sports as
means to achieve the reintegration of the sentenced person into society and
ensure that they do not commit a crime again , observing the benefits that the
law provides for him.
Prisons,
through their authorities, have the obligation to provide by all means at their
disposal the guarantee of reintegration.
In this
regard, the Preventive and Social Reintegration Center of Otumba Tepachico is a
center in which impunity and corruption are experienced, which according to the
National Diagnosis of Penitentiary Supervision 2019, of the National Human
Rights Commission, has an average score of 7.15 tending downwards since it does
not guarantee different aspects of social reintegration. (view image)
With which we
can establish that said center does not meet the necessary standards so that
persons deprived of liberty can access a guarantee of reintegration, as their
right to security is undermined as it is a center aimed at self-government due
to the lack of personnel. security and custody, prone to acts of violence occur
within the center. The inability of the center to guarantee and promote the
right to work and training for this is an aspect that does not at all harm the
guarantee of reintegration, enshrined in articles 5 and 18 of our Magna Carta.
Based on the United Nations Minimum Rules
for the Treatment of Prisoners (Nelson Mandela Rules), for the improvement in
the treatment of persons deprived of liberty at the Preventive and Social
Reintegration Center of Otumba Tepachico, the authority has failed to comply
with:
Rule 91 “ The treatment
of persons sentenced to a sentence or custodial measure must be aimed, insofar
as the duration of the sentence allows, to instill in them the will to live in
accordance with the law and to maintain the product of their work and create in
them the aptitude to do it ”.
Regarding work, the authority has not
complied with the provisions of:
Rule 96
1. Sentenced inmates will have the
opportunity to work and actively participate in their reeducation, following a
physical and mental fitness opinion issued by a doctor or other competent
health professional.
2. Inmates will be provided with
productive work that is sufficient to keep them busy during a normal working
day.
We mention
that despite these shortcomings and prison circumstances; Luis Salvador
Escartín González, has demonstrated throughout 18 years deprived of his freedom
the capacity, courage, will and commitment to seek his reintegration as a
functional member of the society to which he belonged; being the main nucleus
of a dignified family leaving his son Luis Escartin Luna at the age of 8 years
without the father figure himself who has completed his studies at the
undergraduate level and is currently 27 years old, and his wife Maria Teresa
Luna Hurtado who has been the financial supporter of a home and who has fought
before all legal entities at the national and international level to prove the
innocence of her husband Luis Salvador Escartín González, being the last resort
the Complaint Petition P-484-2014 that is He filed before the Inter-American
Commission on Human Rights (IACHR) in March 2013, having lost loved ones being his two parents and
two brothers during his prison stay, having been employed in Petróleos
Mexicanos (PEMEX) with File number 628272 since 1988 until 2002 the day of his
arrest and with the work commitment he had before being deprived of his liberty ; that despite the serious irregularities
to the Due Process and the exhaustion of all legal remedies made by the
defense, the Theory of the case in relation to his innocence was denied, who
was the object and victim of the Manufacture of the Crime by Kidnapping (2002),
by Ministerial and Judicial authorities of the State of Mexico and Federal
Judicial authorities, where they issued rulings and violations of Due Process
since their arrest, having a 40-year sentence, and which to date has been
compiling from the day of their arrest (2002) to the present annuity (year
2020); which has damaged their family life project . Complying with the standards requested
in article 18 of the constitution, article 100 of the Law for the Execution of
Privative and Restrictive Penalties of Liberty in the State of Mexico, as well
as what is stipulated in the articles of the National Criminal Execution Law.
In this
measure, Luis Salvador Escartín González, has shown significant progress
regarding the guidelines provided for in the substantive law on the matter for
social reintegration regarding work, job training and education, being a person
who despite The precarious circumstances have made an effort in the
penitentiary where he is deprived of liberty to form part of a society attached
to norms and rules of both social and moral coexistence, which allows him to
access a substitute for punishment, this with in relation to rule 11.2 [4] of the Tokyo Rules.
IV. Right to
health
The right to
health has become one of the guiding principles of reintegration; Currently the
state of health of Luis Salvador Escartín González, has been broken and
suffering a detriment as a result of the torture, the physical and
psychological damage he suffered during his detention to force him to confess
and indict himself for a crime he never committed; From which a neurological
condition has been derived when in March 2014 , while being confined in the Otumba
Tepachico Prison, he suffered a POSTERIOR CEREBRAL ARTERY INFARCTION, EPILEPSY
OF IDIOPATIC CRYPTOGENE ORIGIN and where at this moment he is under medical
treatment and sporadic control , his state of health has been complicated by these sequelae, in
addition to the fact that he currently suffers from depression and visual
problems and with a second urology condition where we currently do not know his
follow-up by the medical area of the prison,
the aforementioned His physical and psychological state of health has been
deteriorating, which is why I believe that this situation has resulted in the
mistreatment and torture that he has been subjected to by ministerial, judicial
and prison authorities.
The Otumba
Tepachico Prevention and Social Reintegration Center does not meet the
standards of adequate medical care and much less with a neurological treatment
that it needs due to the aforementioned consequences, since nowadays medical
attention has not been provided with the specialty in neurology and urology.
As we could
observe in the 2019 National Diagnosis of Penitentiary Supervision of the
National Human Rights Commission, the Otumba Tepachico center does not
guarantee a dignified stay for people deprived of liberty, as it has
deficiencies in the material and hygiene conditions in the accommodation of
people, in the kitchen and dining rooms, as well as in the workshops and sports
areas, which are part of the axes of social reintegration.
According to
the United Nations Standard Minimum Rules for the Treatment of Prisoners
(Nelson Mandela Rules), the state has the responsibility that persons deprived
of liberty enjoy the same standards of medical care as abroad (rule 24) ;
prisons will have a medical care service in charge of evaluating, promoting,
protecting and improving the physical and mental health of persons deprived of
liberty (rules 25, 26, 27, 30, 31, 32 and 33).
The
deficiencies in the guarantee of the right to health and the right to a healthy
environment through a dignified stay have made the penalty that must be
proportional to the crime that is sanctioned and the affected legal right, has
become a penalty transcendental as it is incompatible with the state of health
of Luis Salvador Escartín González, which violates the provisions of article 22
of our Political Constitution of the United Mexican States.
V. The life
project
The court
applies criteria that seek to be in accordance with legality, the center of the
human rights approach, it intends that the judge act seeking justice and for
this he must weigh in his rulings that this prevails beyond legality, spirit,
soul, the essence of justice.
Another
aspect that has damaged the sentence that has become incompatible, a consequence
of the health of Luis Salvador Escartín González, as well as the violation of
his right to reintegration and obtaining a benefit of freedom is the life
project , beginning with moral and physical damage to the right to the family,
which has been limited by the visitation regime established within the center,
as well as by the conditions of self-government that exist within the center
that not only affects the private person freedom, but also transcends the
family, taking care of the safety of each of the members of the family nucleus.
But despite this situation, his family, wife and son have not remained distant,
but on the contrary during these 18 years that he has been deprived of his
liberty and has been the subject of several transfers to prisons in the State
of Mexico without any justification and with the criminal policy that was
implemented during the six-year terms of Felipe Calderón Hinojosa and Enrique
Peña Nieto, (Neza Bordo, Texcoco, Chiconautla, Otumba Tepachico prison for one
year in the discharge module, Sultepec, Valle de Bravo and currently in Otumba
Tepachico) His family has remained close in a fraternal and supportive way with
the inmate, and that despite all the prison violations that they carried out,
the amparos that were filed for the unjustified transfers were denied, knowing
that he does not engage in criminal behavior within prisons and far from any
type of addiction; With the aforementioned, his family has remained close to
Luis Salvador Escartín González since his confinement without stopping to visit
him despite the time, distance and place.
The principle
of the best interests of his first child has been indirectly violated since the
illegal detention and the violation of obtaining a benefit of freedom for Luis
Salvador Escartín González, who at the time of his arrest forced him to
separate from his first child at 8 years old Luis Escartín Luna currently 27
years and years after a second son who is currently 8 years old Sebastián
Escartín Luna, of whom they have been deprived of the integral development of a
family and a dignified life with the father figure, as well as the material and
affective conditions that allow them to live through a family nucleus.
The
deprivation of liberty and more when it derives from arbitrary detention, the
fabrication of guilty and violations of due process affect the entire life
project as a whole. Causing a paralysis of productive life at age 30, separated
for more than 18 years from his family and work nucleus, and that the physical
and psychological health damage will be irreparable for Luis Salvador Escartín
González and his family.
SAW. Claims
With the
above, I intend that in this particular case and its analogues that the judge
can identify, they are resolved independently and in accordance with the rules
of due process for Luis Salvador Escartín González to have confidence in the
impartiality of justice, guaranteeing the principle of legal security and
integral family nucleus.
The guarantee
of a benefit of freedom through reintegration enshrined in the second paragraph
of article 18 of the Political Constitution of the United Mexican States,
involves one of the most precious substantive rights of the human being, such
as freedom, a benefit that Apart from this, it comes as a result of a criminal
proceeding, in which the responsibility of a person in the omission or
commission of an act that by law is classified as a crime was concluded.
Now, in this
order of ideas Luis Salvador Escartín González, is in time and form to be a
creditor of the prison benefit according to the "Law for the Execution of
Privative and Restrictive Penalties of State Freedom" is for the State of
Mexico, which was in force at the time of the events; in accordance with the
provisions of articles 100 and 111 in correlation with article 106 of said law.
Luis Salvador Escartín González, according to the arithmetic operation, was sentenced to 40 years; Three fifths of
said sentence would be equivalent to 24 years, minus the two years granted, it
would be 22 years; Currently LSEG has served the prison sentence of 18 years 1 month as
of October 8, 2002, taking into account the days worked equivalent to 5,671
days until February 2020, which by making the conversion would have in its
favor 2,835 days, equivalent to 7 years 7 months; Therefore, when making the
sum we have a total of 25 years 10 months, that is, LSEG has the legal time for
the proceeding of the benefit corresponding to the conditional freedom in
relation to the partial remission of the sentence and the pre-release treatment;
with adherence to the right to social reintegration guaranteed in
Constitutional Art. 18 .
Therefore, it
is requested that the process of benefit of Luis Salvador Escartín González be attached to the law,
respecting the right to due process of our democratic state, in the same way
attending to the rights of the constitutionality block, as well as the diffuse
control of conventionality, at the pro persona principle and at the
international principle of jus cogens .
Thus, the League for the Defense of Human Rights and
other sister organizations of the early warning network and human rights
defenders stand in solidarity in the cause of Luis Salvador Escartin González,
he is respected within the process in the Criminal Execution Court In order to
obtain a prison benefit, all the rights are marked in the Political
Constitution of the United Mexican States and in the international treaties
signed and ratified by the Mexican State.
